These General Terms and Conditions (“Terms and Conditions”) govern all offers and
Distance contracts between Montela and consumers who purchase goods remotely.
1. Definitions
The following terms have the meanings set out below in these Terms and Conditions:
Withdrawal period: The period during which the consumer may exercise their right of withdrawal.
Consumer: Any natural person who acts for purposes that are predominantly outside their business or self-employed professional activity and who enters into a distance contract with the company.
Distance contract: A contract between a company and a consumer concluded as part of an organized distance-selling system without the simultaneous physical presence of the parties.
Right of withdrawal: The consumer's right to withdraw from the contract within the withdrawal period.
Company / business: The natural or legal person who offers goods or services through means of distance communication.
Continuing obligation contract: A distance contract for a series of products and/or services supplied or provided over a specific period.
CESOP: The EU's central electronic payment system for collecting certain payment data for tax monitoring purposes.

3. Scope of application
These Terms and Conditions apply to every offer made by the company and to every distance contract between the company and the consumer. The Terms and Conditions are provided to the consumer before the contract is concluded. Any differing terms of the consumer apply only with the company's express written consent.
4. The offer
Offers are non-binding unless expressly stated otherwise.
All prices include all additional costs, such as shipping, customs duties, taxes, and other fees.
5. Conclusion of the contract
The contract is concluded as soon as the consumer accepts the offer and fulfills the specified conditions (e.g., payment).
The company confirms the conclusion of the contract immediately by email or another durable medium.
6. Right of withdrawal
Consumers have the statutory right to withdraw from the contract within 14 days without giving any reason.
The period begins on the day the consumer or a person designated by them receives the goods.
To exercise the right of withdrawal, the consumer must clearly inform the company.
Following withdrawal, the goods must be returned within 14 days. The consumer bears the direct return shipping costs unless otherwise required by law.
7. Refunds Upon Withdrawal
All payments, including standard delivery costs, will be refunded no later than 14 days after notification of the withdrawal.
The refund will be made using the same payment method, unless otherwise agreed.
Repayment may be withheld until the goods are received or proof of return has been provided. Goods should, where possible, be returned in their original packaging and in perfect condition.
8. Taxes, Customs Duties, and Import Charges
The prices shown are final prices and include the applicable taxes.
If import duties or import VAT arise upon delivery,
will be handled in accordance with the applicable statutory provisions.
9. Statutory Reporting Obligations
The company fulfills all legally required reporting obligations,
including the transmission of certain payment details to the competent
authorities to the extent required by law.
10. Conformity and Warranty
The goods conform to the contract and statutory requirements.
Defects must be reported without undue delay, and no later than 14 days after discovery.
For justified defects, repair, replacement, or a refund will be provided in accordance with statutory requirements.
11. Delivery and Transfer of Risk
Unless otherwise agreed, deliveries are made within 14
calendar days. Title and risk pass upon shipment of the goods.
12. Returns and Replacement Deliveries
For defective or incorrect deliveries, the company will arrange a replacement or refund at no cost to the consumer.
In the event of a voluntary withdrawal, the consumer generally bears the return shipping costs.
Refunds are issued no later than 14 days after receipt of the returned goods.
13. Complaints Procedure
Complaints must be submitted in writing with order details and supporting evidence.
The company confirms receipt and responds within 14 days.
14. Liability and Indemnification
The company is liable for proven damages in accordance with applicable law.
Liability may, where permissible, be limited to the purchase price.
15. Documentation and Compliance
Business and shipping records are retained in accordance with statutory requirements, for at least five years.
16. Force Majeure
The company is not liable for non-performance due to force majeure, such as natural disasters, strikes, trade restrictions, or transport disruptions.
17. Applicable Law and Dispute Resolution
Dutch law applies. Disputes will preferably be resolved amicably; otherwise, they will be decided by the competent Dutch courts, unless consumer protection law provides otherwise.
18. Amendments to the General Terms and Conditions
The company may amend these General Terms and Conditions. Contracts already concluded remain
without prejudice to this, unless otherwise required by law.
